Periodical Payments
Following the implementation of the Courts Act 2003, under the revised section 2 of the Damages Act 1996, the Court now has the power to impose a settlement of future losses in personal injury and clinical negligence claims, partly or wholly by way of a Periodical Payment Order. The Court must also consider periodical payments as a means of settlement in all cases involving future losses, irrespective of value.
We work in conjunction with our associated financial services company, DTE Risk and Financial Management Limited, to provide the advice required by the parties, the Court and, where appropriate, the Court of Protection. This can include advice on:
- The annual sums required to meet the Claimant's needs, including any index-linking and stepped changes.
- The capital sum(s) required in addition to the Periodical Payments to meet pre-trial losses, one-off and immediate needs and the contingency fund required to meet emergencies and unforeseen needs.
- The extent to which the Periodical Payment Order will affect the Claimant's ability to receive State or other benefits .
- The comparison of an award including periodical payments with a lump sum award.
Fees
We charge on a fixed fee basis, and will provide a fee estimate in advance of receiving formal instruction.
